1. Agreement to Terms

By downloading, installing, or using the Helmet Vending Machine Manager mobile application ("App"), you agree to be bound by these Terms and Conditions ("Terms"). If you do not agree to these Terms, do not use the App.

These Terms constitute a legally binding agreement between you ("User," "you," or "your") and Helmet Vending Machine Manager ("we," "us," or "our").

2. Description of Service

Helmet Vending Machine Manager provides a mobile application platform for managing helmet cleaning vending machines. Our services include:

  • Multi-language support (English, French, Indonesian)

3. User Accounts

3.1 Registration

To use the App, you must create an account by providing accurate, current, and complete information. You agree to:

  • Provide truthful and accurate information during registration
  • Maintain and update your account information
  • Keep your login credentials secure and confidential
  • Notify us immediately of any unauthorized access

3.2 Account Eligibility

You must be at least 18 years old to create an account and use this service. By creating an account, you represent that you meet this age requirement.

3.3 Account Termination

We reserve the right to suspend or terminate your account if you violate these Terms or engage in fraudulent, abusive, or illegal activity.

4. User Responsibilities

  • Transmit any viruses, malware, or other malicious code
  • Attempt to reverse engineer, decompile, or disassemble the App
  • Use automated systems or software to extract data from the App
  • Impersonate any person or entity or misrepresent your affiliation
  • Harass, abuse, or harm other users
  • Share your account credentials with unauthorized parties

6. Intellectual Property Rights

6.1 Our Rights

The App and all content, features, and functionality (including but not limited to software, text, images, graphics, logos, and icons) are owned by Helmet Vending Machine Manager and are protected by copyright, trademark, and other intellectual property laws.

6.2 License

We grant you a limited, non-exclusive, non-transferable, revocable license to use the App for your personal or business use in managing your vending machines, subject to these Terms.

6.3 Restrictions

You may not copy, modify, distribute, sell, or lease any part of our App without our prior written consent.

7. Data and Privacy

8. Third-Party Services

The App integrates with third-party services including:

  • Firebase (Google Cloud): For backend services, authentication, and database
  • Google Maps: For location services and mapping
  • Payment Providers: For processing transactions (if applicable)

Your use of these third-party services is subject to their respective terms and conditions. We are not responsible for the actions or policies of third-party service providers.

9. Fees and Payment

9.1 Subscription Plans

Helmet Vending Machine Manager may offer various subscription plans or pricing tiers. Details about pricing, billing cycles, and payment methods will be clearly communicated within the App.

9.2 Payment Terms

  • All fees are non-refundable unless otherwise stated
  • Subscription fees are billed in advance on a recurring basis
  • You are responsible for all applicable taxes
  • We reserve the right to modify pricing with 30 days' notice

9.3 Free Trial

If we offer a free trial, you may be required to provide payment information. You will be charged when the trial period ends unless you cancel before the trial expires.

10. Disclaimers and Limitations of Liability

10.1 "As Is" Basis

THE APP IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

10.2 No Guarantee

We do not guarantee that:

  • The App will be uninterrupted, timely, secure, or error-free
  • The results obtained from using the App will be accurate or reliable
  • Any errors in the App will be corrected
  • The App will meet your specific requirements

10.3 Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, HELMET CLEAN SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES.

11. Indemnification

You agree to indemnify, defend, and hold harmless Helmet Vending Machine Manager, its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses, including reasonable attorneys' fees, arising out of or in any way connected with:

  • Your access to or use of the App
  • Your violation of these Terms
  • Your violation of any third-party rights
  • Any data or content you provide through the App

12. Partner Management

12.1 Partner Invitations

You may invite partners to collaborate on machine management. You are responsible for:

  • Managing partner permissions and access levels
  • Actions taken by partners you invite
  • Ensuring partners comply with these Terms

12.2 Data Sharing

When you add partners, you authorize the sharing of relevant machine and transaction data with those partners.

13. Termination

13.1 By You

You may terminate your account at any time by contacting us or using the account deletion feature in the App.

13.2 By Us

We may suspend or terminate your account immediately, without prior notice, if you breach these Terms or engage in prohibited activities.

13.3 Effect of Termination

Upon termination:

  • Your right to use the App will immediately cease
  • Your data may be deleted according to our data retention policy
  • Provisions that should survive termination will remain in effect

14. Modifications to Terms

We reserve the right to modify these Terms at any time. We will notify you of any changes by:

  • Posting the new Terms on this page
  • Updating the "Last updated" date
  • Sending an in-app notification or email (for material changes)

Your continued use of the App after changes become effective constitutes your acceptance of the revised Terms.

15. Governing Law and Dispute Resolution

15.1 Governing Law

These Terms shall be governed by and construed in accordance with the laws of Indonesia, without regard to its conflict of law provisions.

15.2 Dispute Resolution

Any disputes arising from these Terms or your use of the App shall first be attempted to be resolved through good faith negotiations. If negotiations fail, disputes shall be resolved through binding arbitration in accordance with Indonesian law.

15.3 Class Action Waiver

You agree that any dispute resolution proceedings will be conducted only on an individual basis and not in a class, consolidated, or representative action.

16. Force Majeure

We shall not be liable for any failure or delay in performance due to circumstances beyond our reasonable control, including but not limited to acts of God, war, terrorism, riots, embargoes, acts of civil or military authorities, fire, floods, accidents, network infrastructure failures, strikes, or shortages of transportation, facilities, fuel, energy, labor, or materials.

17. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary so that these Terms will otherwise remain in full force and effect.

18. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Helmet Vending Machine Manager regarding the use of the App and supersede all prior agreements and understandings.
